Exceptional skills visas are considered by the Department of Home Affairs on a case by case basis and there is no set criteria for the a successful application.

The Exceptional Skills work visa {Section 19(4) of the South African Immigration Act, Regulation 16(6)}, is obtained on the grounds that a foreigner possesses exceptional skills in an area. This visa allows the candidate to work for any employer (no new application would be required when changing employer) and the successful candidate can also operate an own business without needing to apply for a South African Business Visa.
